PICKLEBALL ACT PARTICIPANT WAIVER AND RELEASE AGREEMENT

1. Personal Responsibilities
I acknowledge that Pickleball ACT is committed to maintaining a safe and respectful environment, free from unacceptable behaviour such as abuse, harassment, intimidation, bigotry, or violence. I agree to conduct myself in accordance with these standards and understand that failure to do so may result in my removal from the event.

I accept full responsibility for my personal health and safety, including:

• Preparing appropriately (e.g., warm-up, stretching, sun protection).
• Managing my hydration and monitoring my health during participation.
• Ceasing play if I feel unwell.

I understand that Pickleball ACT session hosts and assisting members are not certified pickleball coaches, fitness trainers, or medical professionals. I will seek independent professional advice if needed.

2. Release and Waiver of Liability and Indemnity Agreement

For Members:
I understand that as a financial member of Pickleball ACT or the Pickleball Association of Australia (PAA), I am covered under PAA’s personal accident insurance (PAI), which is subject to exclusions and limitations, including no coverage for pre-existing or degenerative conditions. I acknowledge that I have reviewed the insurance policy details available on the PAA website.

For Non-Members:
I acknowledge that by participating in Pickleball ACT events, I do so at my own risk. I am aware that participation in pickleball may involve physical risks, including but not limited to:

• Physical, bodily, or psychological injury, or even death.
• Physical exertion beyond my accustomed level.
• Equipment failure or use of inadequate equipment.
• Lack of adequate treatment or transport facilities in case of injury.
• Injury caused by other participants or external conditions.
• Injury or death due to negligence or breach of duty by Pickleball ACT or its affiliates.

I agree to release, indemnify, and hold harmless Pickleball ACT, its officers, employees, volunteers, and affiliates from any liability, including negligence, for any personal injury, illness, property damage, or other losses incurred as a result of my participation in any activities.

3. Image Release Waiver
I grant permission to Pickleball ACT and its representatives to capture and use photographs, videos, and other media of me taken during events for promotional and marketing purposes, including but not limited to social media, websites, advertisements, and press releases.
I understand and agree that:

• I waive any right to inspect or approve the use of my image.
• I will not receive compensation for the use of my likeness.

4. Exclusion of Liability Under Australian Consumer Law
I understand that under the Australian Consumer Law and relevant state legislation, that by signing this waiver, I agree that I am waiving my rights to sue Pickleball ACT’s liability for any:

• Death;
• Physical or mental injuries (including aggravation of existing injuries);
• The contraction, acceleration, or recurrence of a disease;
• Any other harmful condition resulting from participation in recreational activities;
  is excluded to the maximum extent permitted by law;

That may be suffered by me resulting from the supply of the recreational services or recreational activities provided.

I acknowledge that this waiver constitutes a risk warning under the Civil Liability Act 2002 (NSW & WA) and similar legislation in other jurisdictions.

5. Declaration and Acknowledgment
I declare that:

• I am medically and physically fit to participate.
• I have disclosed any pre-existing medical conditions that may affect my participation.
• I agree to abide by Pickleball ACT Code of Conduct and Guide to good sportsmanship and Pickleball Etiquette.
• I consent to first aid or medical treatment at my expense if needed.
• I have not consumed any alcohol or substances that may impair my ability to participate.

·         I have read carefully and understand this risk warning and waiver of liability and sign it freely and voluntarily without inducement of any kind.

For Participants under the age of 18

This is to certify that I, as a parent/guardian with legal responsibility for the Participant, acknowledge, understand and accept all the above and consent to their release as provided above. I release and agree to indemnify and hold harmless Pickleball ACT from any and all liabilities arising from my minor child’s involvement or participation in the activities and/or recreational services, even if arising from the negligence of Pickleball ACT.
